The question of how Optimax's unique methodology and business ethics are compliant with the requirements of provincial law (Canada), individual (US), federal (Canada and US) and European Union (GDPR – General Data Protection Regulation) established by various regulatory agencies and court decisions is sometimes a matter of concern for our clients.
The administrator of personal data is Optimax Human Performance Inc. based in Ontario, Canada. Recipients of personal data are entities cooperating with the Administrator in the provision of services. Personal data will be processed only to implement the contract when generating reports on character diagnosis. The following rights apply to personal data:
Within the framework of the requirements of the abovementioned provisions and judicial decisions, scientific surveys and assessment instruments are allowed and recommended. In general, the legal requirements of these agencies indicate that all management tools used in the selection or promotion of employees can not discriminate against an applicant or employee based on race, religion, sex, age, national origin or disability. The analytical results provided by Optimax to its clients and business partners cannot be used as a basis for discrimination in any form. The results obtained by us, due to their inherent objectivity tend to eliminate discrimination, but ultimately it is the obligation of each person and organization that uses these results to ensure that people are properly treated and that recommendations are implemented in a non-discriminatory manner.
Optimax is not responsible for the misuse of the results of its analyzes or for any damages that may arise from the use of research, analyzes, reports, and presentation of results. Optimax consistently makes every effort to maintain the highest standards of scientific accuracy and reliability when developing analyzes. Reports prepared by Optimax, however, are provided on a "as is" basis. Optimax makes no warranty, express or implied, as to the suitability and accuracy of the results of the assessment and interpretation, mainly if they arise from the misunderstanding of assessment questions or inaccurate, misleading or otherwise incorrect answers to the questions. Under no circumstances will Optimax be liable for any damages, including without limitation lost profits, lost savings, business interruptions, personal injury and any other damages arising from the use, distribution, interpretation or understanding of Optimax reports, even if Optimax has been informed about the possibility of such damages. It should also be noted that every person has the right to refuse to participate in surveys or surveys administered by Optimax or any business partner.
The surveys or analytical instruments in use by Optimax are uniformly and universally applied to both sexes, all racial and ethnic groups, all religious affiliations, all ages, and the disabled. Since it is the responsibility of every organization to ensure that any program is consistently applied to conform to the above requirements, Optimax recommends that the character profile analysis is applied to every employee of the organization, or to every candidate for a position, etc.
Optimax methodology The Character Identification system is by definition objective. The goal of the Psychocybernetic Character Model according to Professor Marian Mazur, which forms the basis of the theoretical framework for our method, is to enable scientific, context-free and objective identification of character traits. This is also the main advantage of the Optimax methodology in relation to the traditional, highly subjective techniques that are currently in use. Our analytical results do not depend on the age, sex, race, ethnic origin, disability or religion of a given person. In fact, Optimax does not even receive information about the client's race, ethnicity (other than the place of birth, only to confirm the mother tongue and to determine the language of the diagnosis of character), disability or religion.
Following the requirements of objectivity and non-discrimination, data on date of birth are collected in a personal questionnaire mainly for identification (to enable distinguishing two people with the same first and last name). Age, however, is one of the dynamic character parameters and is necessary for proper interpretation of the diagnosis results. Of course, some character traits predictably change over time and are related to the biological age of a person, which is why they are essential for the interpretation of the character profile. Optimax does not draw any conclusions based on age. However, age plays an indirect role in character understanding, which allows us to draw conclusions about character development, such as emotional age. It should be emphasized that Optimax, consciously and intentionally, does not perform or support any research or other activities in which the age of a person is a discriminating factor.
Regarding the gender of the person being diagnosed, we collect information only to be able to use the appropriate salutation in reports. Optimax does not intentionally act, or in any way support any research or analysis that treats the sex of a person as a discriminating factor. Optimax does not generate reports or analyzes describing differences between respondents in the context of comparing "typical" male and female characteristics and behaviors.
In cases in which the diagnosis of character is used as a tool to recruit candidates and select employees for the position, mathematical models of workplaces are developed. To select the best candidate for a given job, Optimax develops a ranking list of all candidates with recommendations. Reports related to the job position provided to potential employers or employment agencies include only the relevant parts of the candidate's full profile.
Optimax is committed to ongoing research and development, thanks to which our tools and methods are scientifically proven. Among other things, this includes the statistical validation of parameter measurements to ensure their compliance with the mathematical model and minimization of measurement error. As for the accuracy of our results, we actively seek feedback from our customers and business partners. All current assessments of diagnosed people indicate that the accuracy of Optimax analyzes significantly outperforms any other tools available on the global market.
Reports provided by Optimax may contain sensitive personal information and are always marked as "Private and confidential". Reports are prepared solely to be used by diagnosed persons and organizations with the explicit consent of the persons subjected to the examination. Optimax undertakes to comply with the highest standards of professional ethics and does not disclose the content of the reports, in whole or in part, to any other party, unless it is with the consent of the respondents. However, Optimax reserves the right to use the results of diagnoses in the field of promotion, research, and any other activities it deems appropriate in a way that prevents the identification of persons participating in the study.
